Provisional schedule for the application of European GHS regulations

(Excerpt from the proposed REGULATIONS OF THE EUROPEAN PARLIAMENT AND COUNCIL regarding the classification, labelling and packaging of substances and mixtures, amending Directive 67/548/CEE and Regulation (CE) 1907/2006).

Article 57
Repeal

Directives 67/548/CEE and 1999/45/CE have been repealed, effective 1st June 2015.

 

Article 58
Transitional Provisions
1. Until 1st December 2010, substances will be classified, labelled and packaged in accordance with Directive 67/548/CEE. Until 1stJune 2015, mixtures will be classified, labelled and packaged in accordance with Directive 1999/45/CE.

2. Contrary to Article 60 and Paragraph 1 of this article, substances and mixtures classified in accordance with Paragraph 1 may, during the period prior to 1st December 2010 and 1st June 2015, respectively, be classified and labelled in accordance with these regulations. In this case, the provisions pertaining to labelling in Directives 67/548/CEE and 1999/45/CE are not applicable.

3. As of 1
st December 2010 and until 1st June 2015, substances will be classified according to both Directive 67/548/CEE and these regulations. They will be labelled and packaged in accordance with these regulations.

4. Substances and mixtures that were classified and put on the market prior to 1st December 2010 and 1st June 2015, respectively, do not have to be labelled and packaged in accordance with these regulations.

 

Article 59
Reclassification

When a substance has already been classified in accordance with Directive 67/548/CEE prior to 1st December 2010, suppliers must reclassify this substance as of that date, in accordance with Section II of these regulations, or they may adapt the classification using the conversion table provided in Appendix VII.

  

Article 60
Effective Date

These regulations shall go into effect on the twentieth day after they are published in the Official Journal of the European Union.
Sections II, III and IV are applicable for substances as of 1st December 2010 and for mixtures as of 1st June 2015.
